In a recent update, Rolling Stone revealed that a judge in Los Angeles made a ruling on Tuesday, March 12, stating that Julia Misley, the accuser, had exceeded the two-year statute of limitations when she included emotional distress claims related to books in her lawsuit against Steven Tyler.

Misley claimed distress after reading accounts mentioned in Tyler’s 2011 memoir and a 1997 Aerosmith autobiography detailing her history with the musician.

As the statute of limitations had expired regarding distress caused by the book accounts, the judge removed that part of Misley’s lawsuit against Tyler. However, Judge Ronald F. Frank permitted Misley to pursue distress damages against the musician concerning the alleged incidents themselves.

The core “causes of action” in the complaint were allowed due to state legislation at the time of filing, enabling the pursuit of decades-old claims of child molestation. Initially citing child sexual assault and child sexual battery in her suit against Tyler, Misley’s claims were recognized.

Steven Tyler, from Aerosmith, has denied accusations of sexually assaulting a minor. His legal team filed a new document claiming that the relationship in question, now central to the lawsuit, was consensual.

Tyler was previously anonymously identified in the suit but was officially named by the court in February.

The lawsuit alleges sexual assault, sexual battery, and infliction of emotional distress against Julia Misley, formerly Julia Holcomb, during a relationship in the ’70s.

Tyler has sought dismissal of the suit and argues in the new filing that Misley “has not suffered any injury or damage as a result of any action” by him, according to Rolling Stone.

Asserting that their relationship was consensual, Tyler also contends that he had immunity as Misley’s legal guardian during the alleged incidents, using parts of her claims against her.

Allegations of Sexual Assault Against Steven Tyler

In her lawsuit, Misley refers to Tyler’s memoirs, where he mentions almost marrying a teenager and gaining custody consent from her parents to avoid legal issues while traveling.

Misley alleges feeling powerless against Tyler and claims she was coerced into believing their relationship was romantic. She further accuses Tyler of engaging in criminal sexual conduct.

Reportedly, an agreement with Misley’s family granted Tyler guardianship. Holcomb also claims she became pregnant with Tyler’s child at 17 but underwent an abortion at his insistence.

Tyler’s response, presented by attorney Shawn Holley, includes 24 defenses refuting all allegations. Among them, Tyler argues that Misley’s claims are partially or entirely barred by her consent and by his immunity as her caregiver and guardian.
